Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Dump on the Trenches website, application and related interfaces (collectively, the “Service”). By connecting a wallet, joining the waitlist, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is (and isn't)

Dump on the Trenches is a non-custodial trading interface for Solana tokens. It helps you discover tokens and route swaps through third-party liquidity aggregators (including Jupiter and DFlow). We are a software interface only:

  • We never take custody of your funds, tokens, or private keys. Every trade is signed by you (or, for the AI Agent, by a key you generate and control — see §7).
  • We are not a broker, dealer, exchange, money transmitter, custodian, or investment adviser, and we do not provide financial, legal, or tax advice.
  • Transactions settle on public blockchains and are irreversible. We cannot cancel, reverse, or refund them.

2. Eligibility

You must be at least 18 years old and legally permitted to use the Service where you live. You may not use the Service if you are located in, or a resident of, any jurisdiction where the Service or trading in digital assets is prohibited, or if you are subject to sanctions. You are responsible for compliance with all laws that apply to you.

3. Extreme risk — you can lose everything

The Service is used to trade memecoins and other highly speculative digital assets. These are volatile and frequently go to zero.

  • You may lose 100% of the funds you deploy. Only trade what you can afford to lose entirely.
  • Tokens may be scams, “honeypots,” or rug-pulls. On-chain risk signals we show (e.g. mint/freeze authority, holder concentration, liquidity locks) are informational, may be incomplete or wrong, and are not a recommendation.
  • Nothing on the Service is investment advice or a solicitation to buy or sell any asset. All trading decisions are yours alone.

4. Fees

The Service charges a platform fee of up to 1% on swaps routed through it, taken on the SOL side of the trade at execution. On certain routes the fee may not be collected. Network (gas), priority, and third-party aggregator fees are separate and paid by you. Fees may change; the fee in effect at the time of a trade applies.

5. Early access

During pre-launch, claiming an early-access spot is free and requires a valid referral code and a connected wallet. Any credit, benefit, bonus, or timing described at signup is promotional, discretionary, and may be modified or withdrawn (see §6). Nothing at signup is a guaranteed return.

6. Referral program & earnings

The Service may offer referral rewards, sign-up bonuses, milestone bonuses, and a share of platform fees (together, “Earnings”). Earnings are a discretionary promotional program, not a right, wage, security, investment contract, or guaranteed payment. The following terms govern them:

a) Referrals. Each wallet may be attributed to one referrer, set the first time a valid referral is bound and confirmed by a wallet signature. Referral attribution is not retroactive — trades made before a referral is bound do not count. Referring yourself, or binding a wallet you also control, is prohibited and voids the associated Earnings.

b) Sign-up & referral bonuses. Advertised bonuses (currently up to $50 as a sign-up bonus and $10 per qualifying referral) are contingent, promotional credits. Unless stated otherwise at the time, a bonus only becomes eligible once the relevant wallet(s) reach a cumulative trading-volume threshold (currently $10,000 in swap volume) and meet any other conditions we set. Volume is measured on-chain / from your trades and snapshotted server-side; client-reported figures are not authoritative.

c) Fee-share & intel earnings. Where offered, a portion of platform fees generated by wallets you refer, and rewards for contributing community “intel,” accrue to your balance under the rules shown in-product. Accruals are estimates until finalized and may be adjusted for errors, chargeback-equivalents, or abuse.

d) Anti-abuse. We may withhold, reduce, reverse, or forfeit any Earnings, and suspend participation, if we reasonably determine there is: self-referral or collusion; Sybil, bot, or wash/volume-farming activity; use of multiple wallets to multiply bonuses; spoofed volume; exploitation of a bug; or any breach of these Terms or applicable law.

e) Payment, changes & taxes. Earnings are payable only if, when, and in the form we make available (which may be after launch), subject to a minimum threshold and identity/eligibility checks we may require. We may change, pause, or end the program, adjust amounts, thresholds and conditions, or expire unclaimed Earnings, at any time and at our discretion. You are solely responsible for any taxes on Earnings or trading gains.

7. AI Agent (automated trading)

The optional AI Agent trades autonomously on your behalf within limits you set (budget, per-trade size, daily profit goal, trade cap). If you enable it:

  • It trades from a dedicated agent wallet that you generate or import. Its private key is encrypted with your passphrase and stored only in your browser; we never receive, store, or have access to it. If you lose the key or passphrase, we cannot recover it or your funds.
  • It runs only while the app is open in your browser. It selects tokens and sizes exits automatically using heuristics; it cannot guarantee profit and may lose the entire agent-wallet balance. Profit “goals” and loss stops are targets, not promises.
  • You are solely responsible for funding, running, monitoring, and withdrawing from the agent wallet, and for all trades it makes. Fund it only with what you can afford to lose.

8. Wallets, keys & security

You are responsible for your wallet(s), private keys, seed phrases, and passphrases, and for everything done through them. We do not store your main wallet key. Keep backups; anyone with your keys controls your funds. We are not liable for losses from phishing, malware, compromised devices, lost keys, or third-party wallet software.

9. Acceptable use

  • Don't use the Service for unlawful activity, market manipulation, fraud, money laundering, or sanctions evasion.
  • Don't attack, overload, scrape abusively, reverse-engineer to exploit, or interfere with the Service or others' use of it.
  • Don't misrepresent the Service, impersonate it, or abuse the referral/earnings program.

10. Third-party services

The Service relies on third parties (e.g. blockchain networks, RPC providers, liquidity aggregators such as Jupiter and DFlow, wallet providers, and hosting/analytics vendors). We don't control them and aren't responsible for their acts, outages, pricing, routing, or failures. Your use of them may be subject to their own terms.

11. No warranty

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, accuracy of data (prices, signals, PnL, or risk indicators), or that it will be uninterrupted or error-free.

12. Limitation of liability

To the maximum extent permitted by law, Dump on the Trenches and its operators, contributors, and affiliates will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, lost tokens, or trading losses, arising from or related to the Service. Our aggregate liability for any claim will not exceed the greater of the platform fees you paid us in the 3 months before the claim, or US$100.

13. Indemnity

You agree to indemnify and hold harmless Dump on the Trenches and its operators from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your trades, your violation of these Terms, or your violation of any law or third-party right.

14. Changes to the Service and these Terms

We may modify or discontinue the Service (or any feature, including the referral program and AI Agent) at any time. We may update these Terms; the “Last updated” date reflects the current version, and your continued use after changes means you accept them.

15. Governing terms

These Terms constitute the entire agreement between you and us regarding the Service. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may.
